Attorney-Led Guidance Every Step of the Way
Every application through Sacramento Trademark Lawyer is reviewed and filed by a licensed U.S. trademark attorney. This reduces rejections, speeds up approval, and protects you from filing errors that DIY platforms usually miss.
We work closely with business owners, influencers, Amazon sellers, clothing brands, tech startups, real estate companies, and service providers to secure strong federal protection for their intellectual property.
The 7-Step Trademark Registration Process
1. Comprehensive Search
Before filing, we conduct a thorough search (federal, state, and common law) to ensure your mark is unique and does not conflict with any existing trademarks. This critical step minimizes the risk of USPTO refusal.
2. Application Drafting & Filing
Our attorney drafts and formally files your trademark application with the United States Patent and Trademark Office (USPTO). We finalize your mark details, confirm the correct International Classifications, and choose the optimal filing basis (Actual Use or Intent-to-Use).
3. USPTO Assignment & Examination
The USPTO assigns your application a serial number and queues it for review. After 3–4 months, a USPTO Examining Attorney (EA) reviews the application for both technical and legal compliance.
4. Responding to Office Actions
If the EA finds any issues (a refusal based on "likelihood of confusion" or a technical error), they issue an Office Action (OA). We prepare and file a professional, timely legal response to overcome the objection. (Note: This step is only necessary if an OA is issued.)
5. Publication for Opposition
If the application is approved by the EA, the USPTO publishes the mark in the Official Gazette. This provides a 30-day window for any third party to file a Notice of Opposition.
6. Notice of Allowance or Registration
A. If filed under Actual Use, and there is no opposition, the mark moves straight to registration. B. If filed under Intent-to-Use, the USPTO issues a Notice of Allowance (NOA). You then have six months to show proof of actual use (Statement of Use).
7. Federal Registration Certificate
Once all requirements are met and all deadlines pass successfully, the USPTO officially registers your trademark and issues the digital registration certificate. Your mark is now fully protected nationwide.
